THE SELLER AND BUYER AGREE TO THE FOLLOWING CONDITIONS:

All sales are FINAL – No Returns – The buyer understands and agrees that there are no refunds and no returns. Seller warrants that this cat/kitten is presented in sound health and free from any disease at the time of sale as far as can be determined by the seller and veterinarian. A health certificate from a board-certified veterinarian will be provided to buyer.

Cat/Kitten Breed from our Cattery

​

• Kitten/Cats are sold as-is and do not leave the cattery till12 weeks of age.  Special consideration will taken on a kitten by kitten basis. 

• Seller warrants that the cat/kitten is presented in sound health and health certificate from a board-certified veterinarian is provided

• The seller guarantees the general health of the cat/kitten for a period of 72 business hours on condition that the cat/kitten is properly cared for and quarantined.

• Buyer has 72 business hours from pickup date (excludes weekends and national holidays), in which cat/kitten is to be examined by a licensed veterinarian. If the veterinarian certifies that, at the time of sale, the cat was unfit for purchase due to a congenital or hereditary disorder, the buyer has the right to return the animal and receive a full refund of the purchase price (excludes all veterinary costs) or request a replacement. The buyer must notify us within 2 business days and provide all documentation of the veterinarian’s determination that the cat/kitten was unfit or the buyer forfeits the right to return the kitten.

• If the buyer fails to complete the mandatory 72-hour exam this contract will be rendered null and void.

• Buyer understands that purchasing a kitten is a responsibility that entails maintaining the health of the kitten and providing a caring and safe home.

• Frequent and yearly vet visits, proper feeding, good nutrition, vitamin supplements, medications and the cost should be expected.

• Scottish Folds Miami is a PKD/FELV/FIV free cattery. 

• FIV/FeLV, FIP, Ringworm Vaccinations and declawing of paws will void any health guarantee and this contract will be rendered null and void.

• The cat/kitten cannot be returned after the 72-hour health guarantee period has expired or it has been exposed to another cat which has not been currently tested for FeLV, FIV and Ringworm. Proof of FIV/FeLV/Ringworm testing will be required of other cats in the home before a return will be granted.

• Cat/kitten purchased will be spayed/neutered and microchipped prior to leaving, unless breeding rights have been given and approved by us (another document is provided for breeding rights)

• The seller cannot guarantee against HCM (hypertrophic cardiomyopathy), the flexibility of the tail, fold of the ears or cartilage or problems that are associated with this genetic gene. Degree of the fold may change due to age, stress and temperature

• Viral, bacterial colds, bloody stools (a form of worms), ringworm or parasites are common conditions which are easily treated and are not covered in the health guarantee as they are natural things kittens can pick up.

• Vet bills including but not limited to physical exams, rabies vaccine, viral illness, allergies, hip issues, patella issues, cancer, spaying/neutering, fecal exams, parasites, flea control, gingivitis/teeth decay or any other conditions that may arise that is required to keep the kitten/cat healthy is a financial and lifetime commitment that is the buyer’s responsibility to pay at the time of service.

• The temperament of the kitten is not a guarantee, as bad temperament can be a result of improper socialization, discipline, and or training.

• Seller does not cover any condition that may result from injury or neglect.

• Buyer understands that Feline Infectious Peritonitis (FIP) is a viral disease of cats caused by certain strains of a virus called the feline coronavirus. The coronavirus is as common in cats as the common cold is in humans and normally not dangerous at all. Cats infected with coronavirus generally do not show any symptoms and it resolves itself just like the common cold. However, in a small percentage of cats infected with the coronavirus, either by mutation or an anomaly of the immune response, the infection progresses into clinical FIP. Once a cat develops clinical FIP the disease is progressive and almost always fatal. There is no definitive tool for detecting FIP in live cats at this time and there is no cure

• Just because a cat tests positive for coronavirus it does not mean that it has or ever will develop FIP. Because the coronavirus is so prevalent in domestic cats it Is impossible to guarantee against it or FIP. However, as a courtesy, we will cover your new kitten for a month from the date of delivery, against death due to FIP if the diagnosis is confirmed by a licensed vet,  necropsy completed and reports given to us for review. In this unfortunate event, the breeder agrees to replace the kitten with one of equal value as soon as one becomes available.

• The buyer should be aware that during times of stress, such as moving to a new home, being shipped by plane, or meeting new people and animals, cats can exhibit a variety of symptoms, such as sneezing, watery/discharge eyes, runny nose, lack of appetite, constipation, or diarrhea. This is completely normal and usually of short duration.

• Seller is not responsible if landlord, spouse, current pet, or any other individual disapproves or is allergic to the kitten/cat.

• Kitten allergies to cat food, grains, grass or environment and or any other human condition are not covered. The following conditions are also not covered: watery/discharge in eyes, cherry eye, hypoglycemia, cancer, or low-grade heart murmurs, retained baby teeth, or any non-lifestyle changing cosmetic genetic abnormalities.

• Buyer agrees that cat/kitten will never be given or sold to any research laboratory, humane society, or similar facilities.

 

Imported Kittens

All the above apply except:

• PKD/FELV/FIV will not be tested. This is to be done by buyer. 

• FIP – No courtesy kitten can be replaced/given.  If kitten is sick, buyer is to take cat to veterinarian for proper care prior to mutation.  If caught early and treated, kitten has chance of survival. 

• Kittens do not always come spayed/neutered when imported. Spay/Neuter will be the sole responsibility of buyer at their own expense. 

 

Death/Abnormality

In the event of death or severe abnormality the buyer agrees to the following:

• Contact us within 24 hours

• Take cat/kitten immediately to a vet appointment for a examination.  This can include bloodwork, xrays, stool samples and such. 

• If the veterinarian finds no signs of death due to blunt trauma, broken ribs, burn marks in the mouth, obstructions in the throat, or any other physical possibility, the buyer agrees to take the kitten to a licensed pathologist and perform a NECROPSY (at buyers expense).

• Without a conclusive reason of death, the buyer understands that the guarantee is null and void.

• Buyer will provide a copy of all medical records including Necropsy report to ScottishFoldsMiami.

• Buyer is responsible for all medical bills associated with kitten/cat.  

• If the buyer denies a replacement kitten within 30 days of replacement kitten offering, the seller will be under no further obligation and the buyer releases the seller from any further claims.

 

Shipping

• As soon as the kitten is ready for travel, the arrangement will be made with the buyer.

• Shipping cost is extra and is to be paid by the buyer.  

• Delays with shipments can happen.  There may be a delay for a variety of reasons such as weather, mechanical failures of ground or air transportation or other unforeseen events.

• Seller will not be responsible, directly or indirectly, for any delays.

• Buyer understands and agrees that there is no refund for flight delays, airport delays, flight cancellations.

 

 

Cancellation and Returns

Cancellation:

​

Buyer: If a kitten/cat is cancelled by the Buyer, Buyer understands that reservation/ deposit paid is non-refundable and will be retained by the Seller.

Seller: If we feel the kitten/cat is not in good health or believe the kitten/cat will not be going to a good home, we have all right to deny the buyer from purchasing the cat/kitten.  All money will be refunded to the buyer.

 

Returns:

​

As mentioned above, NO return or refunds are allowed.

• Unless criteria for “unfit for sale” is met and proper documentation from a board-certified vet is provided.  

• If within 1 year the cat is found to have a fatal hereditary defect, the seller will replace with another cat/kitten when the seller receives proof of defect in the form of a complete autopsy report and all medical record have been received within 2 days. 

• Buyer is responsible for any medical expenses incurred including necropsy and shipping costs of replacement.

• Seller is not responsible for any return shipping expenses

• Seller does not cover the buyer’s existing pet(s) for parasites or viral illnesses that may have been contracted by the new kittens

• If Buyer has to return the kitten for any reason it will be on a surrender basis with no refund or credit. Seller is responsible for all shipping fees and arrangements. Seller will re-home the kitten through our in-house re-homing program.

Payments

​

Reservation/Deposit:  There is a $500 reservation fee for all kittens.  Once you chose your kitten a deposit for the reservation is required.  The deposit is non-refundable if the buyer cancels the reservation. 

 

Final Payment – The final payment is due 24hrs prior to delivery/pick-up of the kitten. 

This agreement represents the entire agreement between both parties and no other terms or conditions shall be applicable to this sale.
